The State homes program is the largest provider of long-term care for our Nation's veterans with more than 162 State homes across all 50 states and Puerto Rico, totaling over 30,000 beds. They provide skilled nursing care, domiciliary care, and adult day health care to both veterans and non-veterans. Each State home is owned, operated, and managed by each State's government. After certification, VA reviews each State home annually to ensure continued compliance with VA's requirements and standards. These services are either directly offered by the VA, but the VA also collaborates with other community-based agencies. The Department of Veterans Affairs is the only federal entity that oversees all 153 state veterans homes, which provide nursing home care to roughly 14,500 veterans.
Employees haven't always been educated about the existence of this benefit. The members of the Armed Forces depend on the benefits provided by the Veterans Administration. There's one important benefit, however, which is often overlooked.

Examples include the extent to which specialty care is provided or how easy it will be for family members to visit the nursing home resident. Visits from family can improve both the residents' quality of life and quality of care, so it may often be better to select a nursing home that is close over one that may be farther. Veterans and their caregivers should therefore use this information together with other sources of information, such as a personal visit and tour, to determine the long-term care setting that is most appropriate. VA's only enforcement action is to withhold payments to force these state veterans homes to comply, but VA considers this too severe for most situations. VA officials are considering asking Congress for more enforcement authorities. Add to this quotient the amount based on the CMS payment schedule for physician services. The resulting sum is the per diem baseline rate for the State home. In determining the baseline for this formula, we would use the rate for FY 2023 because we anticipate this rulemaking to be finalized and effective on or before October 1, 2023, which is the first day of FY 2024. Therefore, we established an agreement with CMS to obtain average market basket data needed to continue providing an annual per diem rate until this rulemaking is finalized.

They are provided for extended periods of time and can be offered in a variety of settings including your residence, communities, nursing homes, and more. However, eligibility for long-term care will be evaluated on a case-by-case basis. These are generally reserved for veterans with severe disabilities who require short-term care ranging from thirty days to six months. Each of these veterans, whether on active duty, guard, or reserve, who are at least sixty-five years old or have a service-induced disability with little to no income, could potentially qualify for VA benefits. Most veterans do qualify for healthcare benefits, but this is subject to disability and other factors.
Veterans who are not in the priority groups are technically limited to six months of care, but this may be reduced to 30 to 60 days if resources are limited. Veterans in the priority groups are technically entitled to unlimited free care, but again may receive shorter stays due to a lack of funding and resources to accommodate them. An active member of the Armed Forces who was in a DOD hospital, needs nursing care, and will be an eligible veteran upon discharge. VA provides mental health integration in clinical practice and clinical pharmacists embedded in primary care. Employees receive generous vacation and personal leave, including 26 paid days off, 13 sick days and 10 paid federal holidays. The Department of Veterans Affairs pays for about 14,500 veterans to live in 153 state-run nursing homes as of FY2021. VA oversees these homes by inspecting them to ensure that they meet the agency's quality standards. The CLC Compare replicates Medicare’s five-star rating method as closely as possible, but is still a “work in progress”. For instance, VA is only able to report 11 out of 16 Medicare quality measures for skilled nursing facilities. We are working on the remaining 5 and plan to release those over the next year once they are available. In addition to the three types of nursing home care available to you, you might also be eligible for long-term care provided by the VA.
All State homes are owned, operated, and managed by State governments, except for a small number operated by entities under contract with State governments. Neither these contractors nor State governments are small entities as defined in 5 U.S.C. 601. State homes subject to this proposed rulemaking are State homes that are currently under a State home care agreement, those that enter into a new agreement, and any facility that begins an agreement for the first time. The effect of the rule would impose no direct costs on the State homes. Therefore, pursuant to 5 U.S.C. 605, the initial and final regulatory flexibility analysis requirements of 5 U.S.C. 603 and 604 do not apply. Each of these 3 domains are assigned a star rating, and, in addition, an overall 5-Star rating calculated to allow as close of a comparison to community nursing homes as possible.
